ORDER

The petitioners, who were arrested and remanded to judicial custody on 03.05.2026 for the alleged offence under Sections 191(2), 191(3), 331(1), 296(b), 115(2), 103(l) and 351(2) BNS in Crime No.36 of 2026 on the file of

the respondent police, seeks bail.

2. The case of the prosecution is that a murder took place in furtherance of a land dispute between the de facto complainant and the petitioners. Hence, the case.

3. The learned counsel for the petitioners submitted that the petitioners have been falsely implicated in this case and they have not committed any offence as alleged by the prosecution. He further submitted that the petitioners are in custody since 03.05.2026 and they are ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays to grant bail to the petitioners.

4. Per contra, the learned Government Advocate (Criminal Side) appearing for the Respondent Police reiterated the prosecution case and submitted that there are totally ten accused in this case. He further submitted that investigation is still pending.

5. I have given my anxious consideration to either side submissions and perused the materials available on record.

6. Considering the facts and circumstances of the case; taking note of the

submission made by the learned Government Advocate (Crl.Side) that the investigation is still pending and the nature of allegation against the petitioners, this Court is of the firm view that it is not appropriate to enlarge the petitioners on bail at this stage.

7. Accordingly, this Criminal Original Petition stands dismissed. 05-06-2026 SHL To:
