ORDER

(The case has been heard through video conference) The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 6(4) of TN Scheduled Commodities (RDCS) order 1982 and r/w 7(1)(a) (ii) of EC Act 1955, in Crime No.41 of 2020 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner was found to be illegally transporting 1300 kgs of PDS rice without any valid licence or permit. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and she has been falsely implicated in this case. However, on instruction, he would further submit that the petitioner without prejudice to her defence, is prepared to make considerable donation to any Charitable Organization or Association.

4. The learned Additional Public Prosecutor would submit that the petitioner was in possession of 15715 Kg of PDS rice without any valid licence. He would further submit that there are two previous cases pending against the petitioner. Hence, he vehemently opposed for the grant of anticipatory bail to the petitioner.

5. Taking into consideration the allegations and also the bad antecedent of the petitioner and the fact that the case is in the initial stage of the investigation and that the custodial interrogation of the petitioner is essential, this Court is not inclined to grant anticipatory bail to the petitioner.
