Article 14 and 16 of the Constitution of India and consequently direct Respondents 1 to 3 to consider and appoint the Petitioner as Assistant Professor (Botany) in the 3rd Respondent College from the date the Respondents 4 to 15 were appointed with arrears of salary from date, fixation, continuity of service from 16.07.2007, the date the Petitioner has been appointed as Guest Lecturer with all other attendant and consequential benefits. ORDER

It is noticed that in a collateral proceedings in W.P.No.19939 of 2014 and W.P.No.36827 of 2016, the Writ Court has allowed the Writ Petitions filed by the unsuccessful candidates vide Order dated 17.11.2022 whereby the appointments made to the post of Assistant Professors and Professors were set aside vide Pachaiyappa's Trust Board Notification No.03/2013 dated 12.12.2013, Notification No.01/2014 dated 18.02.2014 and Notification 4/9

No.01/2015 dated 02.02.2015.

2. It is noticed that those persons who were aggrieved by the Order of the Writ Court dated 17.11.2022 in those Writ Petitions have now approached the Division Bench of this Court in W.A.Nos.2558 of 2022 etc., batch and the case was also heard by the Division Bench of this Court on 26.02.2025 and is now listed for continuation on 10.03.2025.

3. In view of the Order passed in W.P.No.19939 of 2014 and W.P.No.36827 of 2016 on 17.11.2022, the present Writ Petition is dismissed as having become infructuous. However, liberty is given to the petitioner to work out the remedy in W.A.Nos.2558 of 2022 etc., batch before the Division Bench of this Court. No costs.
