Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the 1st respondent herein to consider the name of the petitioner for promotion to the post of (1) Director of Public Libraries or (2) Joint Director of Public Libraries or (3) Deputy Director of Public Libraries keeping his qualifications experience and seniority in view.

ORDER

Seeking a direction to the first respondent to consider the name of the petitioner for promotion to the post of Director of Public Libraries /Joint Director of Public Libraries/Deputy Director of Public Libraries, in view of his qualifications, experience and seniority, the present writ petition came to be filed before this Court.

2. When the matter was taken up for consideration, the learned counsel for the petitioner, on instructions, submitted that the subsequent to filing of this writ petition, the petitioner has attained the age of superannuation. However, the learned counsel submitted that the petitioner may be given liberty to approach the authority concerned with fresh representation seeking notional and terminal benefits, for which, the learned Additional Government Pleader appearing for the respondents has no serious objection.

3.Considering the facts and circumstances of the case and having regard to the submissions made by the learned counsel appearing on either side, this Court permits the petitioner to submit a fresh representation enclosing all the required documents, along with a copy of this order to the respondents, within a period of two weeks from the date of receipt of a copy of this order. On such submission, the respondents shall consider the same and pass appropriate orders on merits and in accordance with law, within a period of six weeks thereafter. 4.Accordingly, this writ petition stands disposed of. No costs.
