Prayer: This Petition is filed under Articl3 226 of the Constitution of India to issue a Writ of Mandamus or any other Writ or direction in the nature of Writ directing the 1st to 5th respondents to permit me to stay along with my mother at No.149, SLR Camp, M.Mettupatti, Valayapatti post, Namakkal 637020 till the disposal of the case in connection with Crime No.1 of 2025 on the file of the 4th and 5th respondent police, based on my representation dated 18.4.2026 and pass such orders as this Honble Court may deem fit. ORDER

This Writ Petition is filed seeking for a Writ of Mandamus directing the 1st to 5th respondents to permit the petitioner to stay along with his mother at No.149, SLR Camp, M.Mettupatti, Valayapatti post, Namakkal 637020 till the disposal of the case in connection with Crime No.1 of 2025 on the file of the 4th and 5th respondent police, based on the petitioner's representation dated 18.4.2026.

2. The petitioner is an accused in Crime No.1 of 2025 for the offence U/s 14(B) of the Foreigners Act and Section 111(2)(b) and 351(2) of the B.N.S.

Though the petitioner was granted bail she being a Sri Lankan National, a direction was issued to reside her in the Trichy Special Camp on 27.02.2026. It is stated that the petitioner's mother is residing in SLR Camp, M.Mettupatti, Valayapatti Post, Namakkal. Now petitioner's mother suffered fractures in right hand and right leg. Therefore, the petitioner has to take care of the her mother. Hence, the petitioner gave representation to the 1st to 5th respondents on 18.04.2026 to permit her to stay along with her and the same has not been considered till date, which has given rise to this petition.

3. The learned counsel for the petitioner submits that as her mother suffered a serious fall, resulting in fractures to her leg and hand and since she is bedridden she has to take care of her mother. He further submits that she has been falsely implicated in this case due to the reason that she had some interaction with the accused persons. Hence, prays to allow this petition.

Mr. John Sathyan, the learned Public Prosecutor appearing for the respondents has filed a counter and submitted that the mother of the petitioner is at present residing with her sister at Navalur, chennai. He further submitted that the case is under crucial stage of investigation and there is possibility for the petitioner to abscond. Hence, prays to dismiss this petition.

5. Heard both sides and perused the materials available on record.

6. The crux of the case is that that the mother of the petitioner has sustained fractures and the petitioner has to take care of her mother. On the submissions made by the learned Public Prosecutor it is made clear that the mother of the petitioner is now under the care of the sister of the petitioner. Hence, the prayer sought for by the petitioner to reside along with her mother cannot be granted at this stage.

7. In view of the above, this Writ Petition( Criminal) stands dismissed. No costs.
