Respondents Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Mandamus to direct the respondents 1 to 3 to release the death beneficiary and other beneficiary of demised Subramaniyan son of Nadesan and pursuant petitioner application Vide No. Ka.KU. No E1483 /AR3/TNTCS/2024 dated 14.02.2024 and further direction the 1 to 3 respondents follow the service records.

ORDER

This Writ Petition has been filed for a direction directing the respondents to release the death benefits and other benefits of demised Subramaniyan.

2. Heard the learned counsel appearing for the petitioner; the learned counsel appearing for the first respondent and the learned Special Government Pleader appearing for the second and third respondents.

3. The petitioner is claiming to be the wife of Late Subramaniyan, who died while he was in service as Conductor under the second respondent Corporation. According to the petitioner, she got married to the said Subramaniyan in the year 1984 and gave birth to three children. Thereafter, he also got married to the fourth respondent and gave birth to two children. However, all the death-cum-terminal benefits were not settled so far, since there is a dispute between the petitioner and the fourth respondent.

4. The learned counsel appearing for the petitioner would submit that now the fourth respondent has no objection to disburse all the benefits to the petitioner including family pension.

5. In view of the above, the third respondent is directed to conduct enquiry, after issuance of notice to the petitioner and the fourth respondent, after deciding the real beneficiary, send a proposal to the first respondent for the purpose of disbursal of death-cum-terminal benefits and also for family pension, within a period of twelve weeks from the date of receipt of a copy of this order.

6. With the above direction, this writ petition stands disposed of. No costs.
