Prayer: Criminal Original Petition filed under Section 438 Cr.P.C. to enlarge the petitioner on bail in the event of her arrest in connection with Crime No.100 of 2020 on the file of the respondent police.

ORDER

(The case has been heard through video conference) The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 392 of IPC later altered to Sections 392 of IPC and r/w.109 of IPC in Crime No.100 of 2020 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that on 17.03.2020 the defacto complainant one Mani along with his daughter travelling on his Motor Cycle, at that time, the petitioner along with other accused waylaid the defacto complainant and snatched the gold chain from the defacto complainant's daughter. Hence the complaint.

3. The learned Counsel for the petitioner submitted that the petitioner is an innocent person and she has not committed any https://hcservices.ecourts.gov.in/hcservices/

offence as alleged by the prosecution and a false case has been foisted against her. He further submitted that the petitioner is a Law Graduate and the petitioner's name is not found in the FIR. Hence, he prays for grant of anticipatory bail to the petitioner.

The learned Additional Public Prosecutor submitted that the petitioner is the wife of the first accused and he would further submit that three similar previous cases pending against the petitioner. He further submitted that the investigation is still pending. Hence he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the allegations and also the bad antecedent of the petitioner and the fact that the case is in the initial stage of the investigation and that the custodial interrogation of the petitioner is essential, this Court is not inclined to grant anticipatory bail to the petitioner.
