(438 of BNS r/w 442 of BNS Act), to set aside the order dated 06.03.2025 passed by the Judicial Magistrate, Arcot, Ranipet District in Crl.MP.No.34 of 2025 in crime no.660/2024 and direct to release the vehicle, Innova Car bearing registration Number TN 05 AV 2999 owned by the petitioner by allowing this criminal revision petition. O R D E R

This Criminal Revision has been filed against the order dated 06.03.2025 passed by the Judicial Magistrate, Arcot, Ranipet District in Crl.MP.No.34 of 2025 in respect of crime no.660/2024, thereby dismissed the petition filed to return a vehicle.

The petitioner owned the vehicle - Innova Car bearing registration Number TN 05 AV 2999. While being so, on 20.11.2024, the vehicle was found to have involved in transportation of illicit liquor without any permission and without any valid permit. Therefore, FIR was registered in crime No.660 of 2024 for the offence punishable under Sections 4(1)(A) and 4(1-A)(ii) of Tamilnadu Prohibition Act and Section 123 of BNSS Act, 2023. In pursuant to the registration of FIR, final report was filed and the vehicle was seized and deposited before the Judicial Magistrate Court concerned. The petitioner is arrayed as the accused. The petitioner filed a petition to return the vehicle before the court concerned and the same was dismissed on the ground that the vehicle has to be confiscated under the Tamilnadu Prohibition Act. 3.

The learned Additional Public Prosecutor submitted that the

confiscation proceedings is still under progress. 4.

In view of the above submission, this Court is not inclined to entertain this criminal revision case and as such, the same is liable to be dismissed.
