1.The prayer made in the application is as follows: ".... to grant an interim injunction restraining the respondent from demanding and collecting any further maintenance charges from the members of the applicant association pending initiation and disposal of arbitration proceedings in terms of clause 12.4 of the Agreement for Maintenance ....."
2. Learned counsel for the applicant association says that this application is, broadly, predicated on non-fulfilment of obligations by the respondent, which, interalia, requires it to provide maintenance services under the maintenance agreement executed with the members of the applicant association.
3.In my view, no relief, as sought for by the applicant, can be granted, for the following reason. It is open to the members of the applicant association to not pay the maintenance charges, if requisite services are not rendered by the respondent.
