PRAYER : Petition filed under Article 227 of Constitution of India to issue appropriate direction to dispose of the interlocutory application in I.A.No.1 of 2023 in O.S.No.182 of 2001 on the file of the Principal Subordinate Court, Coimbatore within a time stipulated by this Court by appreciating the above stated facts and circumstances.

O R D E R

This Civil Revision Petition has been filed to issue appropriate direction to dispose of the interlocutory application in I.A.No.1 of 2023 in O.S.No.182 of 2001 on the file of the Principal Subordinate Court, Coimbatore within a time stipulated by this Court.

2. The suit in O.S.No.182 of 2001 has been filed before the Subordinate Court, Coimbatore for partition. The petitioners are defendants 2 to 5 in the suit. In the said suit, a preliminary decree has also been passed on 01.07.2008. Page 2 / 5

It is the case of the petitioners that the petitioners had filed an application seeking to pass a supplementary preliminary decree declaring their enhanced shares pursuant to the judgment passed in A.S.No.107 of 2008 dated 17.06.2011. The grievance of the petitioner is that though their shares have been enhanced in A.S.No.107 of 2008 as early as on 17.06.2011, the petitioners were unable to enjoy the fruits of the decree. Further, the petitioners are aged persons. Hence, the present revision petition has been filed seeking direction for speedy disposal of the application filed by the petitioners.

3. Considering the limited prayer sought for in this revision petition, without going into merits of the case, the learned Principal Subordinate Judge, Coimbatore is directed to dispose of the interlocutory application filed in I.A.No.1 of 2023 in O.S.No.182 of 2001 expeditiously, within a period of four months from the date of receipt of a copy of this Order.

4. With the above direction, this Civil Revision Petition is disposed of. No costs.
