Heard Mr.R.Jothimanian, learned counsel appearing for the petitioner and Mr.L.S.M.Hasan Fizal, learned Additional Government Pleader appearing for the respondents.

2. The writ petitioner is a charitable Institution. Since there was rampant mismanagement, this Court had to intervene. At present, it is under the administration of the Justice V.PARTHIBAN, a Former Judge of this Court. The then Management had constructed the petition mentioned building within the campus of C.Kandasami Naidu College for Men, at Anna Nagar East, Chennai. However they did not obtain any proper approval from the Competent Authority. As a result, the building in question remains under lock and seal. The petitioner was also slapped with the demand for payment of more than a crore of rupees towards property tax. I take judicial notice of the fact that the writ petitioner is a charitable organisation. If an improper act had been committed by the persons in management, then remedial steps will have to be taken.

In such view of the matter, this Court had requested the present Administrator to move the first respondent for regularisation. The present statute permits such regularisation. If the construction of the building in question is not regularised, it will result in utter waste of resources. I, therefore, direct the respondents 1 and 2 herein to favourably consider the application for regularisation of the building in question.
