ORDER

The petitioner, who was arrested and remanded to judicial custody on 02.05.2026 for the alleged offences under Sections 194 and 108 of BNS Act, 2023 r/w Section 12 of Protection of Child From Sexual Offences Act, 2012 in Crime No.218 of 2026 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the defacto complainant is the mother of the victim girl aged about 16 years. The petitioner, aged about 42 years, was working as an English Teacher in a Government Higher Secondary School. It is alleged that due to the stress caused by the activities of the petitioner, the victim girl committed suicide on 27.04.2026. Hence, the case was registered.

3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged in the FIR and that he has been falsely implicated in the case. It is further submitted that the petitioner has no previous case and no bad antecedents. Hence, he prayed for grant of bail to the petitioner.

4. The learned Counsel for Government of Tamil Nadu (Crl.Side) appearing for the respondent submitted that the investigation is still at a preliminary stage. Hence, he opposed to grant bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. This Court is of the view that considering the nature of the allegation and the fact that the investigation is at a preliminary stage, this Court is not

inclined to enlarge the petitioner on bail at this stage.
