S.Mukanchand Bothra(Decaesed) v. The Central Government
W.P . N o . 1 4 6 9 7 o f 20 1 4 W.P.No.14697 of 2014 S.M.SUBRAMANIAN, J.
This writ petition is listed "For Reporting Compliance" of the judgment delivered by this Court on 05.01.2022.
2. The Director General of Police, pursuant to the orders passed by this Court, issued a Circular Memorandum in R.C.No.1579862/Gen.1(1)/2021 dated 19.01.2022 and accordingly complied with the directions issued by this Court. However, in the said Circular Memorandum with reference to the procedures to be followed, in Para 8 and Para 13 in respect of sub-clause (iv) it is clarified that sanction for prosecution has to be obtained wherever required. Such a clarification is necessary in view of the fact that, in all such cases prior sanction may not be required and only if certain dignitaries are proposed to be prosecuted, then alone such sanction from the Central Government or from the authorised officer is required. Thus, in order to avoid confusion in the minds of the implementing authorities, it is to be clarified that sanction for prosecution has to be obtained wherever required.
3. As far as the compliance of the judgment of this Court dated 05.01.2022 is concerned, the respondents have swiftly implemented the directions of this Court, which deserves appreciation from this Court. Accordingly, the active participation of Dr.C.Sylendra Babu, Director General of Police, and Dr.J.Loganathan, I.P.S., Additional Commissioner of 1 / 2 https://www.mhc.tn.gov.in/judis
