There is no representation on the side of the petitioner. The learned counsel for the first respondent represented that the instant Civil Revision Petition has been filed challenging the order of dismissal of an application filed by the petitioner to set aside the ex parte order. According to him, subsequent to the order setting the petitioner ex parte, an ex parte decree has also been passed against the petitioner and therefore, the instant Civil Revision Petition has now become infructuous and nothing survives for further adjudication. He has also made an endorsement to that effect in the court bundle. Accordingly, the Civil Revision Petition is dismissed as infructuous. No costs.
