This Criminal Original Petition has been filed by the petitioner/A1, who was arrested and remanded to judicial custody on 11.06.2024, seeking bail in Crime No.311 of 2024 registered for the offence under Sections 341, 294(b), 323, 397 and 506(ii) of IPC.

2. Learned counsel appearing for the petitioner submitted that the petitioner aged about 24 years, is an innocent person and he has been falsely implicated in this case, since he has several previous cases. He further submitted that the co-accused has been enlarged on bail and the petitioner, who is no way connected with the alleged offence, has been suffering incarceration from 11.06.2024. Hence, he prayed to grant bail to the petitioner.

3. Learned Government Advocate (Criminal Side) appearing for the respondent police objected for granting bail stating that the petitioner/A1 along with A2 and A3 waylaid the de facto complainant, abused him in filthy language, assaulted him and robbed a sum of Rs.800/- at knife point and escaped from the place. He further submitted that the case is under investigation, no recovery was made from the accused and the petitioner is a habitual offender having 12 previous cases including the cases registered under Section 302 IPC, therefore, if he is released on bail, there is every possibility of him absconding and threaten the witnesses. https://www.mhc.tn.gov.in/judis

Taking into consideration the facts and the submissions made by the learned Government Advocate (Crl.Side) that the investigation is at initial stage and the petitioner was arrested only on 11.06.2024 and also considering the antecedents of the petitioner/A1, this Court is not inclined to grant bail to the petitioner.
