Application No.4682 of 2021 in C.S.No.59 of 2018 is filed to condone the delay of 1196 days in filing the written statement of the first Defendant.

2. The first Defendant states that the suit was filed as an ordinary suit and that it was subsequently determined to be a commercial dispute. The Plaintiff has no objection to this application being allowed.

3. Upon considering the reasons set out in the affidavit in support of the said application and being satisfied with the same, Application No.4682 of 2021 is allowed by condoning the delay in filing the written statement.
