The petitioners apprehend arrest at the hands of the respondent police for the alleged offence punishable under Sections 272, 273, 328 of IPC read with Section 24(1), 6(b) of COTPA Act, in Crime No.274 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that, the petitioners were found in possession of banned tobacco products weighing about 104 kgs. Hence, the case.

3. The learned counsel for the petitioners submitted that the petitioners are innocent persons and they are no way connected with the alleged offence. Hence, he prays to grant anticipatory bail to the petitioners. https://www.mhc.tn.gov.in/judis

4. The learned Additional Public Prosecutor submitted that there are three previous cases pending against the petitioners. Hence, he vehemently opposed to grant anticipatory bail to the petitioners.

5. Considering the quantity of the contraband involved in this case and also considering the bad antecedents of the petitioners, this Court is not inclined to grant anticipatory bail to the petitioners.
