Respondents Prayers: The Writ Petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Mandamus, forbearing the respondents herein from constructing the Bus Stand in Survey No.61/1 in Shoolagiri village, Hosur Taluk, Krishnagiri District more fully described in the Schedule to the petition.

O R D E R

This writ petition is filed for seeking Mandamus forbearing the respondents from constructing the bus stand in Survey No.61/1 in Shoolagiri village, Hosur Taluk, Krishnagiri District.

2. According to the petitioner, he is the absolute owner of the property in Survey No.61/1 in Shoolagiri village and his right has been upheld by the Civil Court. An attempt are being made to construct a bus stand on his property.

3. Heard Mr.M.V.Krishnan, learned counsel for the petitioner, Mr.N.Manikandan, learned Government Advocate, for the first respondent and Mrs.Rita Chandrasekar, learned Counsel for the second respondent and perused the records.

4. The learned Government Advocate on instructions submitted that during the pendency of this writ petition, Shoolagiri bus stand was constructed in Survey No.62/5 and the respondents have no proposal to construct the bus stand in Survey No.60/1. The learned Government Advocate has produced the letter of the Tahsildar, Shoolagiri dated 30.01.2013 to that effect.

5. In the light of the above submission of the learned Government Advocate, this Court is of the opinion that no further adjudication is necessary in this writ petition. Recording the said submission, the writ petition is closed. No costs. Consequently, the connected Miscellaneous Petition are closed.
