PRAYER: Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure, to direct the second respondent to register the case in respect of the petitioner's complaint dated 09.09.2021.

O R D E R

This Criminal Original Petition is filed to direct the second respondent to register the case in respect of the petitioner's complaint dated 09.09.2021.

2.The learned Government Advocate [Crl. Side] submitted that the second respondent police has received a complaint from the petitioner and enquiry is pending.

3.In view of the submission of the learned Government Advocate [Crl. Side], without going into the merits and veracity of the complaint, this Court directs the second respondent police to conduct preliminary enquiry and register the FIR, if cognizable offence is made out, as per the guidelines issued by https://hcservices.ecourts.gov.in/hcservices/

the Hon'ble Supreme Court in the case of Lalitha Kumari vs. Government of Uttar Pradesh reported in AIR 2012 SC 1515. Otherwise, closure report shall be sent to the petitioner, within a period of three weeks, from the date of receipt of a copy of this order. If the petitioner feels aggrieved, he can file a protest petition.

4.With the above directions, this Criminal Original Petition is disposed of.
