Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondents 1 and 2 to consider the petitioners for promotion to the post of Assistant Administrative Officer as per the notification issued by the 2nd respondent dated 01.08.2014 and consequently promote them if they are found eligible for promotion. ORDER

The relief sought for in this writ petition is to direct the respondents 1 and 2 to consider the petitioners' candidatures for promotion to the post of Assistant Administrative Officers as per the notification issued by the 2nd respondent dated 01.08.2014 and consequently promote them, if they are found eligible.

2.Today, when the matter was taken up for consideration, the learned standing counsel appearing for the respondents submitted that the petitioners already filed W.P.(MD).No.13467 of 2015 before the Madurai Bench of this Court for the very same relief and by order dated 31.07.2015, the said writ petition was disposed of, directing the respondents to consider the request of the petitioners for promotion to the post of Assistant Administrative Officers, if they are otherwise found eligible. Pursuant to the said Order, the 2nd respondent herein has considered the claim of the petitioners and ultimately rejected the same, vide proceedings dated 21.08.2015. It is further submitted that challenging the said proceedings, the petitioners filed W.P.(MD).Nos.15510 to 15517 of 2015, which by a common order dated 10.12.

2015, were dipsosed of, by quashing the impugned proceedings of the 2nd respondent and observed that the petitioners are entitled to participate and compete in the future vacancies for the promotional post of Assistant Administrative Officers. Aggrieved over the same, the respondents preferred writ appeals in W.A.Nos.1413 to 1419 of 2015 which were entertained and an order of interim stay was granted by a Division Bench of this Court and the writ appeals are pending. In such circumstances, nothing survives for adjudication in the present writ petition, according to the learned counsel.

3.Recording the aforesaid submission made by the learned standing counsel appearing for the respondents, this writ petition is closed. No costs. Consequently, the connected Miscellaneous Petition is also closed.
