Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus to call for the records relating to refusal check slip No.RFL/Sathyamangalam/41/2024 dated 24.05.2024 and quash the same and further direct the 2nd respondent to register the order passed by the Sub Judge in OS.No.77/2013 dated 04.04.2017 presented by the petitioner's within a stipulated period as fixed by this Court.

By consent of both sides, this Writ Petition is disposed of at the stage of admission itself.

2. Challenge has been made to the refusal slip issued by the respondents. The petitioner had presented the decree in OS.No.77 of 2013 dated 04.04.2017 passed by the Sub Court, Sathyamangalam for registration before the authorities. However, the authorities refused to register the same on the ground that the value has to be paid based on the guide line value.

3. According to the respondents, as per the circular in Na.Ka.No.34930/C1/2019 dated 27.02.2023, 1% of the suit value is required to be paid while registering the Court orders.

4. As per the circular, insisting the petitioner to pay fees under the guideline value does not arise. Accordingly, the impugned order dated 24.05.2024 stands quashed.

5. In such view of the matter, the petitioner is directed to present the document by paying fees as per the circular referred to above. The 2/4

respondents shall receive the document and register the same within a period of one week from the date of receipt of a copy of this order. No costs.
