ORDER
The Criminal Original Petition has been filed to transfer the investigation in Crime No.46 of 2021 from the 2nd respondent police to any other agency in CCB.
2. The petitioner had lodged a complaint for the death of her sister's grand daughter, who had committed suicide by consuming sleeping pills. Though immediately a case has been registered in Crime No.46 of 2021 under section 174 CRPC, thereafter no action has been taken. Hence, the present petition.
3. The learned counsel for the petitioner would submit that the deceased Rajalakshmi had a disturbing family life and there
have been murder and suicide in her family. Thereafter, she had developed love affair with one Santhakumar and got married. At that time, she was minor. Hence a case has been registered against the said Santhakumar under POCSO Act and he was remanded to custody. Afterthat, the deceased Rajalakshmi was some time living with the petitioner. Later she had left the home and started to live independently in Thiruvottriyur. Thereafter, she started to work in a Hotel of one Lingaraj. But, she was in a depressed mood. While being so, on 04.02.2021, a message was received from the said Lingaraj informing the petitioner that the said Rajalakshmi had taken sleeping pills and admitted in the hospital. The petitioner, immediately, rushed to Sugam Hospital, Thiruvottiyur and later she died. Though a case in Crime No.46 of 2021 has been registered, thereafter, no action has been taken so far.
4. The learned Additional Public Prosecutor submitted that in this case, when the victim girl was minor, she had married one Santha kumar and thereafter, he was arrested. Hence, she was left alone and living separately. For her survival, she got employment in a Hotel. In the meanwhile, Santha Kumar had come out on bail and later he committed suicide. The Rajalakshmi was employed in the hotel of one Lingaraj and there seems to be some relationship between them and later, the said Rajalakshmi become pregnant. On 04.02.2021, she had taken the sleeping pills and she succumbed to the same. Subsequently, the said Lingaraj also committed suicide. The investigation in this case has been almost completed and awaiting for Vizra Report . On receipt of the Vizra Report, final report will be filed, preferably, within a period of two months.
5. Recording the above submission, this Criminal Original Petition is disposed of.
