ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

The present writ petition is filed praying for a writ of mandamus, to direct the respondents to survey the land belonging to the petitioner in S.No.505/1, measuring an extent of 1 acre at Semandampalayam Village, Sulur Taluk, Coimbatore District, based on the first petitioner's application dated 29.05.2024.

It is submitted by the learned counsel for the petitioners that the first petitioner along with his wife purchased a land comprised in S.No.505/1, measuring an extent of 1 acre situated at Semandampalayam Village, Sulur Taluk, Coimbatore District through a registered sale deed dated 18.05.2023 in Document No.7005/2023 and joint patta has been issued vide patta No.972 in their name. The second petitioner purchased a land comprised in S.No.505/1, 2/5

measuring an extent of 1 acre 16 1/2 cents situated at Semandampalayam Village, Sulur Taluk, Coimbatore District on 07.05.2018 in Document No.1548/2018. Thereafter, the first petitioner submitted a representation on 29.05.2024 to the second respondent to carry out survey in the subject property and has also paid necessary charges. Since the first petitioner's representation was not considered by the second respondent till date, the present writ petition has been filed before this Court.

On this being pointed out, the learned Additional Government Pleader would submit that they would consider the first petitioner's representation dated 29.05.2024 and carry out a survey in the subject property and complete the process within a time frame to be fixed by this Court, which was agreed to by the learned counsel for the petitioners.

In view thereof, the writ petition stands disposed of with the direction to the respondents to consider first petitioner's representation dated 29.05.2024 and carry out a survey in the subject property and complete the process within a period of 8 weeks from the date of uploading of the web copy without waiting for the receipt of certified copy, after giving prior notice to the petitioners, adjacent land owners and other interested parties including rival claimants if any. 3/5

It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the matter on its own merits and in accordance with law. There will be no order as to costs.
