ORDER

This Criminal Original Petition has been filed to direct the respondent police to secure the accused in Crime No.358 of 2019.

2. The learned counsel for the petitioner submitted that despite the FIR has been registered as early as in the year 2019 in FIR No.358 of 2019, neither the investigation has been completed nor charge sheet has been filed. He further submitted that repeated petitions have been filed in Crl.OP.Nos.8787 of 2021 and 21896 of 2022 respectively, for a direction to the respondent to complete the investigation and orders have also been passed on 06.05.2021 and 12.09.2022 respectively, fixing a time frame for completing the investigation. But still, the charge sheet has not been filed.

3.The learned Additional Public Prosecutor for the respondent filed a status report dated 21.11.2022 stating that investigation is under progress and efforts are also taken to arrest the main accused.

4.Taking into consideration of the repeated directions given by this Court and also the fact that the case is pending for a long time and also considering the undertaken given by the respondent police that the charge sheet would be filed within a period of one month, I feel it is appropriate to direct the respondent police to complete the investigation and take all possible efforts to arrest the main accused and file charge sheet within a period of one month from the date of receipt of a copy of this order, taking into consideration of the earlier orders of this Court.

Accordingly, this Criminal Original Petition is disposed and the respondent police is directed to complete the investigation and file charge sheet within a period of one month, taking into consideration of the earlier orders of this Court. 21.11.2022 Index: Yes/No Internet:Yes/No Speaking / Non-Speaking jrs
