COMMON ORDER The petitioners apprehend arrest for the alleged offences under Sections 191 (2), 296 b), 115 (2), 351 (3) of BNS r/w Section 3 of Tamil Nadu Property (Prevention of Damage and Loss) Act, 1992, in Crime No.233 of 2026 on the file of the respondent police seek anticipatory bail. 2.The case of the prosecution is that the defacto-complainant is an Advocate. It is alleged that on 16.05.2026, at about 11.50 a.m., the petitioners while under the influence of alcohol, damaged the defacto-complainant's car bearing Registration No.TN 38 CL 8696. When the defacto-complainant confronted the petitioners, the petitioners used abusive language, physically assaulted them and threatened them with dire consequences. Hence, the case.
3. The learned counsel for the petitioners submitted that the petitioners are innocent and have been falsely implicated in this case. He further submitted that the occurrence took place on 16.05.2026 and no one was injured. He submitted that this is a case and case in counter. Hence, he prayed to grant anticipatory bail to the petitioners.
4.The learned counsel for the intervenor submitted that the petitioner in Crl.O.P.No.13434 of 2026 is an habitual offender with three cases pending
against him and as against petitioner in Crl.O.P.No.13435 of 2026 there are five previous cases pending. He further submitted that the Inspector of Police, North Police Station, Tiruppur, had already sent a complaint against Gowri Shankar, to the Bar Council of Tamil Nadu & Puducherry on 13.05.2026. The learned counsel for the intervenor also submitted that for no fault of theirs, the defactocomplainant and his son were assaulted indiscriminately by the petitioners and their friends, numbering ten in total. This factum was reiterated by the learned Government Advocate (Criminal Side) appearing for the respondent police. Hence, he opposed to grant anticipatory bail to the petitioners.

I have given my anxious consideration to the submissions made by the learned counsel on either side and perused the materials available on record. 6.Though the case appears to be a regular one, while looking into the factual position, here both the petitioner / Gowri Shankar and the defactocomplainant are Advocates. It is shocking that learned professionals have fought in this manner and are now approaching this Court for anticipatory bail. A more shocking fact is that Gowri Shankar, a member of the legal profession, has three previous cases of a similar nature and the other co-accused has five previous cases. From their conduct, this Court is of the firm view that they are prone to misusing the liberty granted by the Court and subverting the course of justice. Therefore, as rightly contended by the learned Government Advocate,
these petitioners does not deserve anticipatory bail. Accordingly, this Criminal Original petition is dismissed.
