O R D E R
The relief sought for in the present writ petition is to direct the respondents to initiate action against the persons, who had quarried illegally in the common land without the permission of the Government.
2.It is an admitted fact that there is a civil dispute pending between the petitioner and the respondents 4 to 7. The alleged illegal quarry is occurring in the private land and therefore, it is for the petitioner to initiate appropriate action before the competent civil Court of law for preventing the persons from illegal quarry or otherwise. Contrarily, in respect of such civil dispute, writ proceedings need not be entertained.
3.In view of the fact that already a civil suit is pending between the parties, appropriate relief may be sought for in the said civil suit.
4.With these observations, the writ petition stands disposed of. No costs.
