ORDER
This Writ Petition has been filed challenging the impugned order dated 18.03.2024 passed by the 3rd respondent and consequently directing the respondents to provide access from the National Highways NH45A to the lands of the petitioner in Kothattai Village, Bhuvanagiri Taluk, Cuddalore District.
2. The learned counsel appearing for the petitioner would submit that the petitioner has given a representation dated 23.11.2023 for the purpose of access from the National Highway to the petitioner's land and the same was rejected hence, the present writ petition is filed.
3. The learned Standing Counsel appearing for the respondents 1 and 2, by referring the paragraph 13 of the counter affidavit, would submit that the petitioner supposed to have filed application in a proper format requesting
access permission as per norms toward any one end of toll plaza in terms of the circular dated 26.06.2020. However, in the present case, no such application was made as per the norms therefore, the respondents are not in a position to consider.
4. Heard the learned counsel appearing for the petitioner as well as the respondents and perused material available on record.
5. Admittedly, the petitioner made a representation on 23.11.2023 for the purpose of access permission but, it is not filed in a proper format as stated by the respondents. Therefore, the petitioner is directed to make fresh application in a proper format in terms of the circular dated 26.06.2020 to get access permission. If any such application is received, the concerned respondent is directed to dispose of the same, in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.
6. This Writ Petition is disposed of with the above terms. No costs. Consequently, connected miscellaneous petition is closed. 27-03-2026 Index: Yes/No Speaking/Non-speaking order KKN
