By consent, the Writ Petition is taken up and disposed of at the admission stage itself.
2. This Writ Petition has been filed to issue a Writ of Mandamus, to direct the respondent to consider and pass orders, on the petitioner's representation, dated 23.02.2016, to include the petitioner's name in the panel of eligible Forester fit for promotion as Forest Ranger for the year 2015-2016 in the appropriate place in accordance with the seniority as maintained till date and to promote him as Forest Ranger with all consequential service and monetary benefits.
3. The petitioner was appointed as Junior Assistant. Thereafter, he was promoted as Forester. He was included in the seniority list of Forester for the year 2007-2008 at Sl.No.182. In the list of eligible Forester fit for promotion as Forest Ranger of the year 2014-2015, the petitioner's name was not included, because, he had not completed the Departmental Test. https://hcservices.ecourts.gov.in/hcservices/
During 2015, the petitioner completed the Departmental Test. He made a representation to the respondent to consider his claim for empanelment and promotion to the post of Forest Ranger for the year 2015-2016, but, there was no response. Hence, the present Writ Petition has been filed seeking the relief stated supra.
4. Ms.T.Dharani, the learned counsel for the petitioner would submit that the petitioner would be satisfied, if the respondent is directed to consider the representation of the petitioner, dated 23.02.2016, and to pass appropriate orders.
5. Mr.Inbanathan, the learned Government Advocate, who took notice on behalf of the respondent, has got no serious objection in directing the respondent to consider the representation of the petitioner, dated 23.02.2016 and to pass appropriate orders, on merits and in accordance with law.
6. Considering the above submission, this Court, without going into the merits of the claim made by the petitioner, directs the respondent to consider the representation of the petitioner, dated 23.02.2016, and pass appropriate orders, on merits and in accordance with law, as expeditiously as possible. It is made clear that this Court has not expressed any opinion with regard to the merits of the claim made by the petitioner.
