The above C.M.P. Is filed to modify the order of this Court dated 05.08.2021 passed in C.M.P. No. 7342 of 2021 to the extent of allowing the petitioner to deposit Rs.20 lakhs to the credit of C.M.P. No. 7342 of 2021 in A.S. No. 119 of 2021.

When the matter is taken up, the learned counsel for the petitioner has handed over Demand Draft bearing No. 725761 dated 30.01.2023 for a sum of Rs.20 lakhs drawn on Canara Bank, Mumbai PrabhaDevi-II, Mumbai to the learned counsel for the respondent and the learned counsel for the petitioner sought permission to withdraw the C.M.P. He has also made an endorsement to that effect. S. VAIDYANATHAN,J.

In view of the permission sought, the C.M.P. is dismissed as withdrawn. The payment made by the learned counsel for the petitioner is recorded.

Since E.P. is pending, final orders can be passed in the said E.P. and it shall be kept in a sealed cover till the disposal of A.S.No. 119 of 2021.
