Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus, call for the records in the proceedings Legal Heir Certificate dated 28.11.2014 issued by 3rd Respondent in favour of the Respondents 4 to 9 and quash the same as illegal and direct the 3rd Respondent to cancel the legal heir certificate issued in favour of the 4th to 9th Respondents to secure the ends of justice.

Challenging the legal heir certificate issued by the 2nd respondent, the petitioner has approached this Court.

2. According to the petitioner, her parents viz., Thoppalan and Lakshmiammal had two sons and three daughters viz., Lakshmanan, Sundaresan, Ellammal, Thirumali and Rukku. Petitioner is the third daughter. On the death of their mother Lakshmiammal they applied for legal heir certificate to the 3rd respondent on 15.12.2014. Where as the 3rd respondent erroneously included the daughter in law and eliminated the daughters who were the first class legal heirs. Aggrieved over the same, she made a representation on 22.12.2014, till date corrected legal heir certificate has not been issued.

3. Considering the long pendency of application for legal heirship certificate, a direction is given to the 2nd respondent to conduct enquiry and pass orders on the representation fo the petitioner dated 21.12.2014 within a period of eight weeks from the date of receipt of a copy of this order.
