The writ petition filed under Article 226 of the Constitution of India, to issue a writ of Mandamus directing the respondents to 1 and 2 to rectify the mistake in the Survey number and other particulars in the order dated 15.6.1996 under which the petitioner was granted house site patta in S.No.29/1 and issue necessary orders to that effect forthwith. ORDER

This Writ Petition has been filed seeking direction to the respondents 1 and 2 to rectify the mistake in Survey number and other particulars in the order dated 15.6.1996 under which the petitioner was granted house site patta in S.No.29/1 and issue necessary orders to that effect forthwith.

2. It is grievance of the petitioner that the petitioner was granted house site patta in S.No.29/1 to an extent of 0.01.05 Hectares in Poonkurichi Village, Rasipuram Taluk, Namakkal District. Thereafter, the petitioner came to know that the actual survey number allotted to the petitioner is 27/15 and not 29/1. Hence, the present writ petition has been filed. The learned counsel for the petitioner submitted that this Court may issue a direction to the respondents 1 and 2 to rectify the survey number mentioned in the patta which was granted to the petitioner on 15.06.1996.

3. In view of the above, this Court permits the petitioner to file a fresh application before the respondents 1 & 2 to rectify the said mistake within a period of two weeks from the date of receipt of a copy of this order. If such representation is received, the respondents shall consider the same and pass appropriate orders on merits and in accordance with law within a period of four weeks, thereafter.

4. With the above directions, the writ petition is disposed of. No costs.
