Crl.O.P.No.15181 of 2023 G.CHANDRASEKHARAN.J., The petitioner namely Raj Kumar, who was arrested and remanded to judicial custody on 26.05.2023 registered for the offences punishable under Section 174 of Cr.P.C subsequently altered into Section 302 of IPC in Crime No.202 of 2023 on the file of the respondent police seeks bail.

2. The learned counsel for the petitioner submitted that, petitioner is falsely implicated in a case registered for the offences under Section 174 of Cr.P.C @ 302 of IPC. Petitioner is in Judicial Custody from 26.05.2023. Thus, he seeks bail to the petitioner.

3. In response, learned Government Advocate (Crl. Side) submitted that, A1 is the manager of the restaurant by name "Delicious Restaurant". A2 & A3 are friends of A1 and A4 is working in the Restaurant. On 26.05.2023 at about 06.00.a.m., deceased had ordered some food. Due to some other maintenance work, Restaurant people were 1/3

not able to supply the food ordered by the deceased. Therefore, deceased started abusing the restaurant people in filthy language. There arose a wordy quarrel followed by accused beating the deceased with plastic pipe and wooden log. Due to the assault made against the deceased, he succumbed to injuries. A1 to A4 shifted the body to some other place. Investigation in this case is pending.

4. Considering the gravity of the offences alleged to have been committed by the accused which caused the death of deceased and that the investigation in this case is pending, this Court is not inclined to grant bail to the petitioner.

5. Accordingly, this Criminal Original Petition is dismissed. 10.07.2023 Sma 2/3
