DATED: 05-06-2026

CORAM

THE HON'BLE MR.JUSTICE C.KUMARAPPAN Sunil Patel ..Petitioner(s) Vs The State Rep. by The Inspector of Police Sathuvacheri Police Station, Vellore District.

Crime No.391 of 2024 ..Respondent(s) PRAYER : Criminal Original Petition filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023, to enlarge the Petitioner on bail int he event of his arrest in Crime No.391 of 2024 pending investigation on the file of the respondent police and thus render justice.

For Petitioner(s):

Mr.A. Vijayasankar For Respondent(s):

Ms.R.S.Indira Government Advocate (Crl.Side)

ORDER

The petitioner, who apprehends arrest for the alleged offences under Sections 7(5) and 20(2) of Cigarette and Other Tobacco Products Acts, 2003 and Sections 275 and 123 of the B.N.S. Act, 2023, in Crime No.391 of 2024, on the file of the respondent police, seeks anticipatory bail.

2.The allegation against the petitioner is that the petitioner was involved in illegal possession of HANS, Vimal Pan Masala for the purpose of selling to the general public. Hence, the case.

3.The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any such offence as alleged by the defacto complainant and he has been falsely implicated in this case. He further submitted that he is ready to abide by any stringent condition that may be imposed by this Court and he is ready to co-operate for investigation. Hence, he prays to grant anticipatory bail to the petitioner. 4.However, the learned Government Advocate (Crl.Side) for the respondent would strongly oppose for granting the anticipatory bail by stating that the petitioner has got two previous cases in similar nature, which clearly demonstrates that as and when the petitioner is enlarged on bail, he misused the liberty and again committing the similar nature of offences.

5. I have given my anxious consideration to the submissions made by the learned counsel on either side and also perused the records available. 6.From the submissions made by the learned Government Advocate

(Criminal Side), it is evident that the petitioner has multiple previous cases registered against him. This clearly demonstrates that whenever he was granted anticipatory bail by the courts, he misused the liberty extended to him. Consequently, if the petitioner is enlarged on anticipatory bail, he may be emboldened to commit similar offences in the future without fear of the law. Therefore, taking into consideration the larger interest of society, this Court is not inclined to grant anticipatory bail to the petitioner. 7.Accordingly, this criminal original petition stands dismissed. 05-06-2026 GBI To 1.The Inspector of Police Sathuvacheri Police Station, Vellore District.
