O R D E R

The petitioner has filed this writ petition praying for to issue a Writ or order or direction in particular a Writ of Certiorarified Mandamus calling for the entire records culminating in the impugned order No.960/LAD/MA(5)/2003 dated 29.06.2004 and to quash the same and direct the respondents to remove the name of the Petitioners from the Black List of Oulgaret and Pondicherry Municipalities and restore the petitioner in Original Position and to award contact to the petitioners as per law.

The Petitioner is a registered contractor, particularly, in the contract of removal the garbage and he got removal of garbage contract from Oulgaret and Pondicherry Municiapality without any adverse mark. The petitioner has carried out his contract work in the said Municipality. While impugned order dated 29.06.2004 passed by the Deputy Director of Local Administration Department, Pondicherry, regarding blacklist on several contractor, the petitioner was one among them. Against the order of black list made in No.960/LAD/MA(5)2003 dated 29.06.2004, the present petition is filed.

3. The second respondent has issued impugned order dated 29.06.2004 on the ground of complaint in the poor execution of cleaning collection and transport of garbage works by private contractors working in certain areas, received from the general public and Newspaper report and in pursuance of the advice of the Hon'ble Minister for Local Administration and approval of the Chief Minister issued a black list order against the petitioner and other persons.

4. The black listing order was issued in the year 2004. After a lapse of nearly thirteen years, I do not think that anything survives in the writ petition and there is no any interim order in this writ petition.
