Mr.K.JAYARAMAN, ADVOCATE CR.RC.No.1041 of 2020 and CRL.MP.No.7223 of 2020 (This Criminal Revision Petition is filed to call for the records relating to the order in C.A.No.28 of 2020 dated 05.10.2020 by the learned Principal District and Sessions Judge, Namakkal, confirming the order of the learned Judicial Magistrate Court No.1, Namakkal made in STC No.287 of 2019 dated 29.01.2020 convicting the petitioner under Section 138 of NI Act to undergo simple imprisonment for a period of 2 years and shall pay compensation of Rs.16,40,000 /- and set aside the same by allowing the above Criminal Revision Petition. ) M.Palanivel Petitioner Vs.
S.Saravanan Respondent On representation of counsel for both sides, this case is taken up for settlement before the Lok Adalat. Both the parties are present. Mr.K.A.Mariappan the learned counsel for the Petitioner and Mr.Rishab Kothari, learned counsel appearing for the respondent are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows: TERMS OF SETTLEMENT Both the parties along with their representatives are present. 2.They having compounded the offence, filed Joint Memorandum of Compromise before the National Lok Adalat today (12.03.2022). The Joint Memorandum of Compromise filed today reads as follows: "(a) The petitioner has agreed to pay Rs.6,50,000/- (Rupees
Six Lakhs Fifty Thousand) towards full and final settlement, which is the subject matter of the above Revision Petition on or before 30.06.2022 for which settlement, the respondent has also agreed.
(b)Failure on the part of the petitioner as agreed above on the payment and the duration of the same, the parties have to workout the remedies in the manner known to law." 3.In view of the above settlement arrived at by the parties, the offence charged against the petitioner-M.Palanivel is compounded and as a consequence the conviction and sentence passed by the Trial Court and the Appellate Court stands set aside and the Revision Petition in view thereof is allowed, acquitting the petitioner-M.Palanivel.
