Prayer : Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the 1st respondent to complete the enquiry in Joint Application R.No.A2/13363/2021 dated 25.03.2021 and transfer the permit of the vehicle bearing registration number TN 31 AA 3299 on the route of Chenji-Thirukkovillur within a period specified by this Hon'ble Court.

O R D E R

This writ petition has been filed for the issue of a writ of Mandamus directing the first respondent to complete the enquiry that is pending on the joint application submitted by the petitioner and one J.Vasanthan wherein the petitioner is seeking for the transfer of the permit of the vehicle to the said J.Vasanthan.

2. The case of the petitioner is that, the first respondent had issued permit in the year 2017 in favour of one V.Ramesh, who was plying the vehicle in Chenji-Thirukkovilur route. The petitioner along with the said V.Ramesh made a joint application for the transfer of the permit before the first respondent. There was some opposition and litigations were initiated by the other side. Ultimately, the suits were dismissed and the objections raised by the rival claimants were rejected and the first respondent, by proceedings dated 15.03.2021, transferred the permit in the name of the petitioner.

3. The petitioner has thereafter made a joint application on 25.03.2021 along with one J.Vasanthan seeking for permission to transfer of the permit for the vehicle in favour of the said J.Vasanthan. It is the further case of the petitioner that the parties were called for an enquiry and all the relevant records have already been submitted and in spite of the same, the first respondent has not passed final orders. Left with no other option, the present writ petition has been filed before this Court seeking for the aforesaid prayer.

4. Heard Mr.P.N.Vignesh, learned counsel for the petitioner and Mr.U.Baranidharan, learned Government Advocate appearing for the respondents.

5. Taking into consideration the facts and circumstances of the case and the limited relief sought for in this writ petition, there shall be a direction to the first respondent to complete the enquiry in the joint application in R.No.A2/13363/2021 dated 25.03.2021 and take a decision within a period of six weeks from the date of receipt of a copy of this order.

6. The petitioner is directed to make a fresh representation to the first respondent along with the relevant documents and a copy of this order. With the above directions, this writ petition is disposed of. No costs.
