Respondents Prayer:- The Writ Petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Mandamus, directing the respondents to register and release their sale deed, dated 22.12.2000 registered and assigned pending Ref.No.P155/2000 on the file of the respondent.

O R D E R

According to the petitioner, the petitioner has presented a sale deed, dated 22.12.2000 before the second respondent for registration. The second respondent insisted the petitioner to furnish patta and chitta copies to release the original sale deed. Despite request made by the petitioner to accept the documents to show title of the vendors to the property and release the sale deed, the second respondent is retaining the original sale deed, dated 22.12.2000. Therefore, the petitioner has filed the present writ petition before this Court for the aforesaid prayer.

2 The learned Government Advocate appearing for the respondent would submit that the petitioner by letter, dated 12.3.2019 has stated that civil suit in O.S.No.463 of 2013 is pending on the file of the IV Additional District Munsif, Coimbatore and the petitioner requested the second respondent not to register the documents till disposal of the aforesaid suit and the present writ petition. Therefore, the respondent has not registered the documents.

3. The learned counsel appearing for the petitioner would submit that the said letter issued by the petitioner Trust was misunderstood and the same was issued to prevent registration of documents in respect of the subject matter of the property by third party.

4. Recording the submission made by the learned Government Advocate appearing for the respondents, the writ petition is dismissed. It is for the petitioner to work out remedy before the authority concerned. No Costs.
