Notice is not served on the third respondent. It is seen from the records that the third respondent, who was the fourth respondent in the Appeal, had remained exparte before the Appellate Court, hence notice to the third respondent is dispensed with.

2. Accepting the reasons assigned in the affidavit filed in support of this petition, this petition is allowed, the delay of 18 days in filing the Appeal is condoned.
