PRAYER:

Writ Petition filed under Article 226 of Constitution of India, for issuance of writ of Certiorari calling for records relating to the impugned order of the second respondent in TSE.No.1/2018 dated 19.08.2021 on the file of the second respondent and quash the same.

ORDER

Although this matter is posted under the caption 'for withdrawal', when the matter is taken up for hearing, the learned counsel represented that the parties herein have agreed to amicably settle and the terms of the Memo of compromise dated

25.01.2022 are recorded herein. The contents of the memo shall be read as part and parcel of this order.

"1.The respondents 3 to 5 who are the legal heirs of the deceased first respondent N.Arunachalam agrees to receive a sum of Rs.7,50,000/- in total as full and final settlement as satisfaction to the order in TSE No.1/2018 dated 19.08.2021.

2.The petitioner hereby pays a total sum of Rs.7,50,000/- (Seven Lakhs and Fifty Thousand only) to the respondents 3 to 5 who are the legal heirs of the deceased 1st respondent N.Arunachalam as a full and final settlement in pursuance of the compromise to the order in TSE.No.1/2018 dated 19.08.2021.

3.The said sum of Rs.7,50,000/- (Seven Lakhs and Fifty Thousand only) is paid by of three cheques each for a like sum of Rs.2,50,000/- (Two Lakhs and Fifty Thousand only) in favour of respondents 3 to 5 vide Cheque Nos.000023, 000024, 000025 dated 24.01.2022 of Citi Bank, Citibank N.A., Chennai Branch, as requested by the respondents 3 to 5.

4.In pursuance of the compromise entered between the parties, the respondents 3 to 5 who are the legal heirs of the deceased first respondent N.Arunachalam assures that all disputes between the parties are hereby resolved and both party shall not have any further dispute or claim in any manner against each other.

2.Therefore, the writ petition is disposed of on the above terms of compromise. No costs. Consequently, the connected miscellaneous petition is closed.
