ORDER

The petitioner, who was arrested and remanded to judicial custody on 29.01.2026 for the alleged offences under Sections 123, 131, 296(b), 351(3) BNS r/w Section 77 of Juvenile Justice Act in Crime No.121 of 2026 on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that he gave milk mixed with a small quantity of Ganja to a 12 year old child. Hence, the case.

3. The learned counsel for the petitioner submits that the petitioner is a resident of Nambiyar Nagar, Nagapattinam District and earns his livelihood as a daily wager at the fishing harbour. On the date of the alleged occurrence, the victim child was smoking a cigarette near the village temple. Upon seeing this incident, the petitioner took a photograph and showed it to the victim's parents. He further submitted that having prior enmity with the petitioner's family, the parents filed a false complaint, resulting in the petitioner being arrayed as an accused. The petitioner never committed the offence as alleged by the respondent police. Hence, he prayed for grant of bail to the petitioner.

4. The learned Counsel for Government of Tamilnadu (Criminal Side) appearing for the respondent would submit that the petitioner gave milk mixed with a small quantity of Ganja to a 12 year old child. Hence, he opposed to grant bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

From the submissions of the learned counsel on both sides, it is observed that the allegation against the petitioner is that he gave milk mixed with a small quantity of Ganja to a 12 year old child. Considering the seriousness of the allegation, this Court is of the firm view that it is not desirable to enlarge the petitioner on bail at this juncture.
