Crl.O.P.No. 15543 of 2023 G.CHANDRASEKHARAN.J., The petitioner namely Kalaimagizhan @ Magi, who was arrested and remanded to judicial custody on 15.05.2023 for the offences punishable under Sections 294(b), 341, 307, 120B of IPC in Crime No.230 of 2023 on the file of the respondent police seeks bail.
2. The learned counsel for the petitioner submitted that, petitioner is an innocent person and he has been falsely implicated in a case registered for the offences under Sections 294(b), 341, 307, 120B of IPC in Crime No.230 of 2023. Thus, he seeks bail to the petitioner.
3. In response, learned Government Advocate (Crl. Side) submitted that, in connection with previous enmity, on 14.05.2023 at about 05.00.p.m., petitioner and his father-in-law had attacked the defacto complainant's father with aruval on his leg. As a result, he suffered injuries. He further submitted that, apart from this case, there are 10 previous cases pending against the petitioner. Hence, he vehemently opposed for grant of bail to the petitioner.

4. It is seen from the list of cases, petitioner has 10 previous cases, out of which, four cases are registered under Section 307 of IPC. Considering the nature of injuries suffered by the accused, which is grievous in nature and that the petitioner is an habitual offendor having previous cases and that investigation is not completed, this Court is not inclined to grant bail to the petitioner.
