Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus calling for the concerned records from the second respondent, quash the appointment notification issued by the second respondent on 15.12.2013 in its Website (unom.ac.in) to fill up the 95 posts of Assistant Professor in various departments as illegal, arbitrary and consequently, direct the second respondent to renotify the appointment notification after the first respondent issues orders on recruitment, qualification and selection committee and guidelines on selection procedures pursuant to G.O.Ms.No.350 Higher Education (H1) Department dated 09.09.2009 by adhering to 100 point roster fixed in G.O.Ms.No.85, Personnel and Administrative Reforms (R) Department dated 06.05.2000 and G.O.Ms.No.105, Personnel and Administrative Reforms (S) Department, dated 20.06.2000 and thereafter, proceed with the recruitment process and fill up the vacancies. O R D E R

The writ on hand has been filed challenging the recruitment notification issued by the University of Madras/second respondent on 15.12.2013 in its Website (unom.ac.in) to fill up the 95 posts of Assistant Professor in various departments.

2. With reference to the relief sought for in the writ petition, it is brought to the notice of this Court that pursuant to the impugned recruitment notification, the process of selection was conducted and concluded and the candidates selected were joined in the post of Assistant Professor. Interestingly, the writ petitioner was selected, appointed and now working as Assistant Professor in the University of Madras/second respondent. However, his grievance is that he was selected in general term instead of the reserved category.

3. In view of the fact that the writ petitioner was already selected and appointed and the impugned recruitment notification had already been acted upon and the selected candidates had already joined in service, the question of setting aside the impugned recruitment notification does not arise at all. If the writ petitioner has any other grievance, it is left open to him to approach the competent authority for the purpose of redressal of his grievance.

With these observations, this Writ Petition stands dismissed. No costs. Consequently, the connected miscellaneous petition is closed.
