Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of Writ of Mandamus, to direct the respondents 1,3 and 4 to send fresh pension proposal to the 2nd respondent taking 50% of the consolidated service rendered by the petitioner as Village Assistant from 30.06.1981 to 31.05.1995 (8 years 11 months) along with the service rendered in time scale of pay as Village Assistant 01.06.1995 to 26.09.2017 (22 years 3 months 25 days) with the service rendered as Office Assistant from 26.09.2017 to 31.05.2020 (2 years 8 months and 5 days), totally 33 years 10 months as qualifying pensionable period and further sanction suspension pension within time frame fixed by this Court. Mr.L.S.M.Hasan Fizal, learned Government Advocate takes notice on behalf of the 1st, 3rd and 4th respondents.

Mr.V.Vijayshankar, learned counsel for the respondent takes notice on behalf of the 2nd respondent.

2.This writ petition is disposed at the time of admission considering the submission made by the learned counsel for the respondents, the learned Counsel for the respondents submits that appropriate orders will be passed by the 1st, 3rd and 4th respondents on the representation dated 02.05.2021 of the petitioner and dispose the same within a period of 16 weeks from the date of receipt of a copy of this order. In case, the request of the petitioner is accepted, the 2nd respondent is directed to implement the same within a period of 4 weeks thereafter. No costs.
