Crl.O.P.No.14763 of 2023 G.CHANDRASEKHARAN.J., The petitioner namely C.Saravanan, who apprehends arrest at the hands of the respondent police for the offence under Sections 147, 148, 294(b), 448, 302, 307 and 506(ii) of IPC in Crime No.224 of 2023 on the file of the respondent seeks anticipatory bail.

2. The learned counsel for the petitioner submitted that, petitioner is an innocent person and he has been falsely implicated in a case registered for the offence under Sections 147, 148, 294(b), 448, 302, 307 and 506(ii) of IPC. Apprehending arrest, this petition is filed.

3. In reply, the learned Government Advocate (Crl. Side) submitted that though originally FIR was registered for the offence under Sections 147, 148, 294(b), 448, 302, 307 and 506(ii) of IPC, subsequently it was altered to Section 302 of IPC. There are totally eight accused in this case. Out of eight accused, A1 to A4 surrendered and remanded to Judicial Custody. A5- A7 were arrested and remanded to Judicial Custody. All the accused are in Jail. Petitioner is the eighth 1/3

accused. As per the confessional statement of the co-accused, petitioner supported the co-accused for commission of murder of the deceased. Hence, he strongly opposes this petition.

Considering the specific overt act against the petitioner that petitioner was actively involved in abetting and aiding other accused in the commission of murder and none of the arrested accused had been released on bail and that the investigation is at preliminary stage, this Court is not inclined to grant anticipatory bail to the petitioner.

5. Accordingly, this Criminal Original Petition is dismissed. 04.07.2023 Sma 2/3
