Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India seeking a Writ of Certiorarified Mandamus, calling for the records of the impugned Check Slip dated 30.03.2026 issued by the 3rd Respondent herein and to quash the same and consequently direct the 3rd Respondent 1/5

herein to register the Sale Deed dated 13.03.2026 executed by the Petitioners herein, which has been assigned a Temporary Number in TP/263750916/2026, concerning the property situated at Plot No.8B, Door No.6, Raja Garden, Peravallur, Chennai - 600 082, as per patta land measuring an extent of 96 Sq.mts, or 1033 Sq.ft and as per document measuring an extent of 1155 Sq.ft., comprised in Old S.Nos.252 Part, 252A, T.S.no.2/22 and Block No.33, situated at Peravallur Village then Purasawalkam - Perambur Taluk, now Kolathur Taluk and Chennai District, within Registration District of North Chennai and SubRegistration District of Sembium and within limits of Greater Chennai Corporation of Chennai and to return the same to the Petitioners herein. ORDER

Heard the learned Counsel for the writ petitioner and the learned Additional Government Pleader for the respondent Nos.1 to 3. Issuance of notice to the respondent Nos.4 to 7 is dispensed with.

2. The petitioners executed a sale deed, dated 13.03.2026 and presented the same for registration before the third respondent. Citing the 2/5

objection received from the private respondents, the third respondent declined to register the document. Challenging the Refusal Check Slip, this Writ Petition came to be filed.

3. The learned Counsel for the petitioner points out that the private respondents have not obtained any restraint order against the registering officer.

4. I went through the contents of the Refusal Check Slip. Nowhere, any legally sustainable reason has been set out. The petitioners were also not put on notice or heard before it was passed. It is in this view of the matter, the impugned Check Slip is quashed. The petitioners are permitted to re-present the document. The third respondent shall issue notice to the private respondents herein. The third respondent cannot decline to register the document merely because objection has been received. The third respondent has to verify if the objections are legally sustainable. The third respondent will have to abide by any restraint order that has been passed by the jurisdictional Civil Court. The third respondent cannot mechanically decline to register the document. 3/5

5. This Writ Petition is disposed of in the above lines. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
