This petition has been filed to allow the claimants to have liberty to proceed with the CMA No.1451 of 2022 with a direction in the above appeal for the present.

2. Today, the matter is listed under the caption "for being mentioned", at the instance of the learned counsel for the respondents.

3. The learned counsel for the respondents submitted that the claimants/respondents herein have also filed CMA No.1451 of 2022 as against the Judgement and Decree dated 16.12.2021, in MCOP No.6505 of 2019, on the file of the Motor Accident Claims Tribunal/Sub Court, Chennai, for enhancement. Therefore, the observation made by this Court while dismissing the appeal filed by the respondent in the claim petition may influence the Court while disposing the claimants' appeal. Considering the above submission, it is clarified that the observation made by this Court while dismissing the appeal filed by the respondent in the claim petition may not have any influence while disposing of the appeal filed by the claimants. The claimants/respondents herein are at liberty to agitate their rights for enhancement of compensation in the manner known to law.
