Notice had been served and there is no response. Affidavit of service has been filed.
2. The present application has been filed seeking to condone the delay of 979 days in filing the application to revoke the succession certificate granted in O.P.No.193 of 2019 on 17.07.2019. The applicants herein are Class-II legal heirs of one Ellammal.
3. There is a report of the Tahsildar, Tondiarpet, which reflects that Ellammal died as a spinster. The petitioner in the Original Petition has claimed that he was her son. In the very same report of the Tahsildar, it is stated that such a claim made by the petitioner is the original petition is a false claim.
4. In view of the report of the Tahsildar, order granting the succession certificate has to be examined once again. Therefore, the application is allowed and the delay of 979 days is condoned.
5. The Registry is directed to put up the application filed to revoke the succession certificate, if it is otherwise in order, for the consideration of court on 09.11.2022.
