ORDER : The Court Made the following order :- Petitioner, who was arrested and remanded to judicial custody on 23.08.2021 for the offence punishable under Section 174 of Cr.P.C altered to Section 306 of I.P.C in Cr.No.797 of 2021 on the file of respondent police seeks bail.

2. The case of the prosecution is that the petitioner fell in love with victim girl and defacto complainant and thereafter refused to marry the victim girl and informed that she is going to marry another girl, due to which the deceased girl committed suicide by hanging. Based on the complaint given by the mother of the deceased, the law enforcing agency registered a case against the petitioner. https://hcservices.ecourts.gov.in/hcservices/

3. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that the petitioner is a Christian and the victim girl compelled the petitioner to convert to hindu religion, as she belongs to hindu religion and the same was refused by the petitioner. That apart the petitioner has not committed any offence as alleged by the prosecution. Hence he prays for grant of bail to the petitioner.

4. The learned Government Advocate( Crl side) vehemently opposed for grant of bail to the petitioner by submitting that initially the petitioner promised to marry her and thereafter refused to marry her, due to which the victim girl committed suicide by hanging.

5. Considering the facts and circumstances of the case and the allegation levelled against the petitioner, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original petition is dismissed.
