This petition is filed under Order 41 Rule 19 of Code of Civil Procedure to restore the Second Appeal No.129 of 2012 which was dismissed for non prosecution on 22.06.2015 by this court.

2. Heard Mr.M.Pari, learned counsel appearing for the appellants. 3.M/s.Sarvabhauman Assosiates, learned counsel appearing for the respondents did not raise any serious objection in allowing this petition.

4. This court is also satisfied with the reasons assigned in paragraph nos.3 and 4 of the affidavit filed in support of this petition. In the facts and circumstances, this petition is allowed and the Second Appeal No.129 of 2012 is restored to file.
