Prayer: The Civil Revision Petition is filed under Article 227 of Constitution of India to set aside the appeal proceedings in Appeal No.7 of 2025 on the file of the 2nd respondent.

ORDER

(Order of the Court was made by V.LAKSHMINARAYANAN, J.) The petitioner challenges the maintainability of the proceedings in Appeal No.7 of 2025 before the Debts Recovery Tribunal-III at Chennai.

2. The plea of Mr.T.V.Badrinarayanan, learned counsel for the petitioner is that the Debts Recovery Tribunal is merely adjourning the matter and is not passing any order on the same. According to him, he has discharged all the liabilities and is entitled to have the title deeds of his property returned to him. Whether the order passed by the Tax Recovery Officer / Recovery Officer is correct or not is yet to be decided by the Debts Recovery Tribunal-III.

3. We are sure that if all the pleas that have been raised by Mr.T.V.Badrinarayanan, are raised before the Debts Recovery Tribunal-III, the concerned Tribunal will consider each of the objections and answer the same. Since the proceedings are still pending before the Debts Recovery Tribunal-III,

we are not inclined to entertain this revision. It would suffice to direct the Debts Recovery Tribunal-III to take up Appeal No.7 of 2025 and dispose of the same within a period of eight (8) weeks from the date of receipt of a copy of this order.

4. With the above observation and direction, this Civil Revision Petition stands disposed of. There shall be no order as to costs. (G.R.S., J.) (V.L.N., J.) 27-05-2026 Index: Yes/No Speaking/Non-speaking order Mst/ Asi To
